Medical marijuana was legalized by Louisiana in 2015 after the passing of Act 261, also called the Alison Neustrom Act. Despite legalizing medical cannabis, the use of constrictive wording resulted in the act having limited usefulness. This is especially true for the word “prescribe,” which was used in the act. Physicians are not allowed to write prescriptions for cannabis since it is a schedule I substance. However, doctors can recommend its use to qualified patients.
Two companion bills were passed in 2016 that fixed the language in the first act.
Act 96 and Act 343 also provided legal protection for approved patients and extended conditions that qualify.b By 2020, Act 286 further expanded access to medical cannabis. It now allows physicians to recommend medical marijuana for any debilitating condition, given that the doctor is authorized to treat such illness. The year 2020 also saw the passing of HB211, which protected banks from state penalties if they decided to serve medical marijuana businesses.
Meanwhile, Act 147 was introduced to provide protection for doctors and medical facilities involved with medical marijuana.
