Frequently Asked Questions

Is Medical Marijuana Legal in Louisiana?

Yes. While recreational marijuana is still illegal, medical marijuana is legal in Louisiana.

With the passing of SB 271 in 2016, Louisiana became the first state in the Deep South to create a comprehensive medical marijuana program. Qualified patients can purchase medical cannabis products at state-licensed pharmacies.

SB 271 states that physicians can only recommend and not “prescribe” medical marijuana to their patients. The bill also mandated that medical cannabis must be provided and distributed to patients in processed, non-smokable forms.

However, in 2020, the state passed three new laws relevant to medical marijuana. Among those new laws is HB 819—a bill that enables licensed physicians to recommend medical marijuana to patients with any debilitating condition they believe medical cannabis can treat.
