In 1991, Act No. 874 legalized medical marijuana. Throughout the years, there have been changes in facilitating the licensing of doctors, producers, and pharmacies.

In 2016, a comprehensive medical cannabis program was created. Only physicians can recommend medical cannabis to a patient.

The qualifying conditions for Louisiana medical marijuana were expanded in 2018 and research was conducted on the medicinal value of medical cannabis.

 

In 2020, three new laws relevant to the medical marijuana program were passed:

  • HB 211 — protects banks and physicians.
  • HB 418 — protects hospitals from state marijuana-related prosecution.
  • HB 819 — expanded the list of qualifying conditions, allowing physicians to recommend marijuana for any debilitating condition they are qualified to treat as long as they know the patient will benefit from the medication.

Most recently this year, the legislature and governor approved allowing smoked or “raw or crude” cannabis, starting on January 1, 2022.

Today, there are 9 licensed pharmacies in Louisiana appointed by the Louisiana Board of Pharmacy where patients with a medical marijuana certificate can purchase medical marijuana products.

  1. Copy of driver’s license
  2. State ID
  3. Vehicle registration
  4. Voter’s registration
  5. Correspondence from another state agency with current date or a current car insurance bill.

  • A completed and signed minor form for patients under 18 years of age with a designated custodial partner or legal guardian as the primary caregiver or authorized purchaser.

While recreational marijuana remains illegal, medical marijuana is legal in Louisiana.

Qualified patients are permitted to purchase medical cannabis products at state-licensed pharmacies. With the passing of SB 271 in 2016, Louisiana became the first state to create a comprehensive medical marijuana program in the Deep South.

 

SB 271 states that physicians can only recommend and not “prescribe” medical marijuana to their patients. The bill also mandated that medical cannabis must be provided and distributed to patients in processed, non-smokable forms.

In 2020, the state passed three new laws relevant to its medical marijuana program. Among those new laws, HB 819 enables licensed physicians to recommend medical marijuana to patients with any debilitating condition they believe medical cannabis can treat.

  • Northeast (Caldwell, East Carroll, Franklin, Jackson, Lincoln, Madison, Morehouse, Ouachita, Richland, Tensas, Union, and West Carroll)
  • Northwest (Bienville, Bossier, Caddo, Claiborne, DeSoto, Natchitoches, Red River, Sabine, and Webster)
  • Southeast (Livingston, St. Helena, St. Tammany, Tangipahoa, and Washington)
  • Southwest (Allen, Beauregard, Calcasieu, Cameron, and Jefferson Davis)
  • Teche (Assumption, Lafourche, St. Charles, St. James, St. John, St. Mary, and Terrebonne)

After issuing a recommendation, the doctor generally sends the applicable form of medical cannabis to a licensed pharmacy. The patient will receive a notification once their medical cannabis order is ready to be picked up.

Under the law, patients may possess up to a one-month supply of medical marijuana. The law also limits raw marijuana to 2.5 ounces every two weeks per patient.

The regulatory board responsible for monitoring the dosages and amounts purchased is the Louisiana Medical Marijuana Tracking System.
